Acceptance

By installing, opening, or invoking any feature of SiteCalc, including through Siri, Apple Shortcuts, Spotlight, or any other system integration, you agree to these terms whether or not you've viewed them within the app. If you don't agree, delete the app.

Intended Use

SiteCalc is a construction math reference tool intended for use alongside, not in place of, professional judgment, licensed trade work, and independent verification. It's not intended for use as the sole basis for any construction, electrical, plumbing, mechanical, or structural decision. It's not engineering software and doesn't produce engineered designs, stamped calculations, or permit-ready documents.

Formulas and Code References

Formulas are based on industry standards including the NEC, IRC, IPC, and IFGC. Every calculator shows its formula via the "Show Formula" button. Calculations accessed through Siri or Shortcuts don't include this feature. Code references reflect the edition current at the time this version was published. Codes change on a 3-year cycle, and your jurisdiction may be on a different edition or have local amendments. A code reference in this app doesn't constitute a determination of compliance with any code, standard, or regulation.

No Professional Advice

Nothing in this app constitutes professional engineering advice, architectural advice, code compliance verification, or licensed trade guidance. SiteCalc doesn't evaluate site conditions, soil bearing capacity, wind loads, seismic zones, snow loads, cumulative derating, manufacturer specifications, or any variable beyond the inputs you provide. Using this app doesn't qualify you to perform licensed trade work.

AR Measurement

The camera-based measurement feature uses Apple's ARKit and is approximate. Accuracy depends on device hardware, lighting, surface texture, distance, and calibration. AR measurements can be off by inches or more. Always verify with a physical tape measure or laser.

Voice Input and Siri

Speech recognition can mishear numbers, units, or dimensions. Always review recognized values before applying them. Calculation results delivered through Siri, Apple Shortcuts, or other voice interfaces are subject to these same terms. Siri results are abbreviated and don't include formulas or detailed context.

Material Prices

The built-in price database reflects approximate US national averages as of the date this version was published. Your local prices will differ. The app lets you override any price. No price shown is guaranteed current or accurate for your location.

Service Availability

SiteCalc may experience interruptions, errors, data loss, or unavailability at any time. iCloud sync, Siri integration, AR measurement, voice input, and all other features may fail, produce incorrect results, or become unavailable without notice. Creayo LLC is not responsible for any loss, damage, or inconvenience caused by the unavailability or malfunction of any feature, including but not limited to iCloud sync failures, data loss, corrupted calculations, or inability to access saved work.

No Warranty

SiteCalc is provided "as-is" and "as-available" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, completeness, reliability, and non-infringement. Creayo LLC makes no representation or warranty that any formula, lookup table, code reference, price, measurement, or calculation result is correct, current, complete, or applicable to your situation. The inclusion of formulas, code references, and range indicators does not constitute a representation of accuracy, compliance, or fitness for any purpose.

Waiver of Claims

To the maximum extent permitted by applicable law, you waive any and all claims, causes of action, and demands against Creayo LLC, its owners, members, managers, officers, developers, contractors, employees, agents, affiliates, successors, and assigns (collectively, "Released Parties"), arising from or related to your use of SiteCalc, including but not limited to claims based in contract, tort, negligence, strict liability, product liability, breach of warranty, misrepresentation, consumer protection, or any other legal or equitable theory. This waiver applies to all damages, whether direct, indirect, incidental, special, consequential, exemplary, or punitive, including damages for property damage, personal injury, wrongful death, economic loss, emotional distress, or loss of use.

Limitation of Liability

Without limiting the foregoing waiver, and to the maximum extent permitted by applicable law, the Released Parties shall not be liable for any damages arising from or related to: (a) your use of or inability to use SiteCalc; (b) any formula, calculation, code reference, price, or measurement provided by the app; (c) any construction, installation, purchasing, or design decision made using the app's outputs; (d) any error, omission, or inaccuracy in any calculation or data; (e) any failure or malfunction of iCloud, Siri, AR measurement, voice input, or any other feature; (f) any loss of data, saved work, or custom settings; or (g) any property damage, personal injury, or death. In no event shall the Released Parties' total aggregate liability exceed the amount you paid for the app. This limitation applies regardless of the legal theory and even if a Released Party has been advised of the possibility of such damages.

Assumption of Risk

Construction work is inherently dangerous. By using SiteCalc, you acknowledge that calculation errors, whether caused by the app, by user input, or by misapplication of a formula to your situation, can result in structural failure, property damage, personal injury, or death. You voluntarily assume all risks associated with using this app's outputs for any purpose. You acknowledge that you've had the opportunity to review the formulas used by each calculator and that you accept full responsibility for verifying any output before acting on it.

Third Parties

These terms are between you and Creayo LLC. No third party is an intended beneficiary of these terms or has any rights under them.

Indemnification

To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, actions, suits, losses, damages, liabilities, costs, and expenses (including reasonable legal fees and court costs) arising from or related to: (a) your use of the app; (b) your reliance on any output, formula, calculation, price, or measurement; (c) any construction, installation, or design work performed using the app's results; (d) any third-party claim arising from work you performed using the app; or (e) your violation of these terms.

Dispute Resolution and Arbitration

Any dispute, claim, or controversy arising from or relating to your use of SiteCalc or these terms shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitrator shall have exclusive authority to resolve all disputes, including the scope and enforceability of this arbitration clause. Arbitration shall take place in the state where you reside. Each party shall bear its own arbitration costs, except that Creayo LLC will pay filing fees up to the cost of filing a complaint in court. You agree that all disputes will be resolved individually. You waive any right to participate in a class action, class arbitration, representative proceeding, or private attorney general action.

If the class action waiver is found unenforceable as to a particular claim, then this entire arbitration section is void as to that claim only and that claim shall proceed in court. All other claims remain subject to arbitration. You may opt out of this arbitration clause by emailing legal@creayodev.com within 30 days of first installing the app, stating your name, email, and intent to opt out. This clause doesn't prevent either party from seeking emergency injunctive relief in court to prevent irreparable harm pending arbitration.

Statute of Limitations

To the maximum extent permitted by applicable law, any claim arising from your use of SiteCalc must be brought within one (1) year of the event giving rise to the claim. Any claim not brought within this period is permanently barred. You waive any statute of limitations that would otherwise apply to extend this period.

Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use this app.

Purchase and Payment

SiteCalc is a one-time purchase at $29.99.

• Payment is charged to your Apple ID account at confirmation of purchase.
• This is a one-time purchase. No subscription. No recurring charges.
• Your purchase unlocks everything permanently on all devices signed in with the same Apple ID.
• You can restore your purchase at any time via the App Store.

Refunds are handled by Apple according to their refund policy.

Updates

We may update the app, these terms, formulas, or the price database at any time. Updated formulas may produce different results than previous versions. Continued use after an update constitutes acceptance of the updated terms.

Maximum Recovery

In the event that any waiver, limitation, or disclaimer in these terms is found unenforceable and a court or arbitrator awards damages against Creayo LLC, the maximum total aggregate amount you may recover from the Released Parties for all claims of every kind, whether in contract, tort, strict liability, or otherwise, shall not exceed the amount you actually paid for SiteCalc. This cap applies per user, not per claim, and covers all damages and awards combined. The Released Parties shall have no obligation to pay attorneys' fees, expert fees, or court costs beyond this cap. This section does not limit Creayo LLC's obligation to pay arbitration filing fees as described in the Dispute Resolution section.

Intellectual Property

The app and all its content, features, and functionality are owned by Creayo LLC and are protected by copyright, trademark, and other intellectual property laws.

Severability

Each section, sentence, clause, and phrase of these terms is severable. If any individual section, sentence, clause, or phrase is found invalid or unenforceable by a court or arbitrator, only that specific section, sentence, clause, or phrase is severed. All remaining provisions remain in full force and effect.

Governing Law

These terms are governed by the laws of the State of Delaware, without regard to conflict of law provisions.

Apple

This app is licensed, not sold. Your use is also subject to Apple's Standard Licensed Application End User License Agreement. Apple is not a party to these terms and has no obligation to provide maintenance, support, or warranty for SiteCalc.

Entire Agreement

These terms constitute the entire agreement between you and Creayo LLC regarding SiteCalc and supersede all prior agreements.
